Privacy statement for animal licensing

How we use your information

This privacy statement applies to applications for animal welfare licenses.

Animal welfare licenses are granted, subject to exemptions, to carry out certain activities involving animals under The Animal Welfare (Licensing of Activities Involving Animals) (Scotland) Regulations 2021, The Animal Boarding Establishment Act 1963, Riding Establishments Act 1964-1970, and the Dangerous Wild Animals Act 1976. The above legislation allows the local authority to grant licences following submission of an application and compliance with the relevant licence conditions.

Why we are collecting and using your personal information

We will use the information you give us to carry out the required checks in relation to your application. We may receive information about you from other relevant parties including other services, other Local Authorities or Police Scotland.

If your application is successful, we will use the information in order to fulfil our management and regulation role as a licensing authority. We will place certain information from your application onto a public register as required by law. The register is publicly available to view. We may also use your information to carry out investigations which may be required to assess your suitability to hold a licence.

Lawful basis and how long we keep personal information

We will only process your personal information when it is lawful to do so. For this processing, we are relying on

  • Article 6(1) (e) of UK GDPR – processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority, and
  • Article 6(1)(c) of UK GDPR – processing necessary for compliance with a legal obligation to enable us to comply with the above legislation

In relation to criminal offence information, this information will be processed for reasons of substantial public interest as it will enable us to fulfil the purposes of the legislation stated above. We keep your information as long as required by law. Personal information will be stored for 5 years as part of our retention schedule. 

Information sharing

We share your information with other council services, other public authorities, Police Scotland, Scottish Fire and Rescue Service, and veterinary practices to check the accuracy of information provided on your application and to comply with our legal obligations. Your information will only be processed when it is lawful to do so. Your data will only be accessible by the officers dealing with the application and/or relevant third parties required to be consulted in order to validate and process your application.

We will ask for the following information:

  • name and date of birth
  • full postal address, phone number and email address
  • details of your qualifications, skills, experience, memberships and work history
  • type of application (new/renewal) and licence number where available
  • trading name/address/phone/email
  • name and details of veterinary provider and emergency key holder
  • public liability insurance details
  • disqualifications and/or criminal convictions
  • any other relevant personal information, for example, if certain documents need to be uploaded with the form

Your rights

You have the right to ask us to:

  • tell you that we are using personal information about you, tell you what that information is, and who we have shared it with. You can also ask us for a copy of the information we have about you. This is called the right of access.
  • correct any wrong or misleading personal information that we have about you. This is called the right to rectification.
  • stop using any or all of your personal information. This is called the right to object.
  • delete or destroy your personal information under certain circumstances. This is called the right to erasure.
  • stop using your personal information until we can correct your personal information, give you our reasons for using your personal information or stop us from deleting your personal data if you need it in connection with any legal claims. This is called the right of restriction.
  • pass your personal information to someone else under certain circumstances. This is called the right to data portability.

Where we process your information under legal obligation, certain rights do not apply, such as:

  • erasure
  • data portability
  • objection to processing
  • the right to withdraw consent
