Arranging your civil partnership

Mixed-sex civil partnerships

The Scottish Parliament recently passed legislation which will make civil partnership available to mixed-sex couples. 

It will be possible to submit a notice of intention to enter a mixed sex civil partnership from 1 June 2021. 

A couple who want to enter a mixed-sex civil partnership must submit their notices at least 29 days before the date they want to register their civil partnership. This is the same as for marriage. This means that the first mixed sex civil partnerships in Scotland could take place on 30 June 2021.

The maximum number of people allowed to attend the ceremony will be in accordance with Scottish Government guidance. This guidance is subject to change and you will require to confirm the proposed number of people attending prior to the date of the ceremony. 

We have moved beyond level 0 and most of the remaining legal restrictions on marriage and civil partnership ceremonies, as well as receptions that follow, no longer apply.

The registration ceremony room at the Town House, Hamilton will accommodate 60 seated guests. For clarification, witnesses and children will be included in the total of 60. The couple, up to 2 registrars and a photographer are not included in the 60.

Rules on face coverings

You and your guests will require to wear a face covering within the venue unless an exemption applies.

Couples are exempted from the requirement to wear a face covering during the ceremony provided that there is a distance of at least two metres maintained between the parties and any other person or alternatively a partition between the parties and any other person.

If the registrar is content that existing restrictions, such as those on numbers in attendance, physical distancing and guests wearing face coverings indoors, are being properly observed, the registrar may agree to the couple removing their face covering during the ceremony.

Children under the age of five are not required to wear a face covering.

For couples who require to submit civil partnership notice forms (within three months of the date of civil partnership and no less than 29 clear days):-

National Records of Scotland has authorised registration offices to accept and process marriage/civil partnership notice forms. Our offices remain closed to the public at present however notice forms for ceremonies taking place within South Lanarkshire can be posted to Licensing and Registration Services, Floor 11, Council Offices, Almada Street, Hamilton ML3 0AA together with the supporting documents. Please make sure you provide a daytime contact phone number with your documents to allow us to contact you for payment.

Before the civil partnership schedule is issued we will require to see the original documents. An appointment will be made for you to attend the Council Offices, Almada Street, Hamilton ML3 0AA to collect the schedule and to check the documents. It is now mandatory to wear a face covering when attending the registration office unless an exemption applies to you.
