SummaryA new service arrangement is being put in place from January 2021 for SACRO to provide a Peer Navigator/Recovery Service to young people and adults who are subject to Diversion to Prosecution and who require supports to access local services aimed at helping them to address alcohol or substance use issues. Funding for this service is being provided through the Alcohol and Drug Partnership (ADP).

Diversion from prosecution is a process by which the Crown Office and Procurator Fiscal Service (COPFS) are able to refer a case to social work – and their partners – as a means of addressing the underlying causes of alleged offending when this is deemed the most appropriate course of action (Community Justice Scotland).

A service will be delivered by SACRO workers with lived experience to support young people and adults to link with local addiction and other services, to build resilience through improved social and other support, reducing the negative effect of alcohol and substance use issues on the individual and community, and reducing the risk of further/future involvement with the justice system.

There was a need identified for a PIA due to the processing of personal data. It was identified that the information included personal data, special category personal data and may include personal data relating to criminal convictions/offences. Thorough consideration has been taken in relation to the sharing of the relationship and vulnerability of the data subject, the categories of personal data and the legislation which gives the Council the powers to process the information. An assessment of the overall level of risk in relation to sharing the information has also been considered.

The outcome of the risk assessments and the mitigating actions will ensure that our staff and service providers who support young people and vulnerable adults, do not breach a data protection principle while processing personal data of those service users for whom we have care and protection responsibilities.
