When pollution is a nuisance or affects health

Statutory nuisance abatement notice

An abatement notice can be served to require that an activity causing nuisance is stopped.

A Section 80 Abatement Notice sets out:

  • the nature of the nuisance
  • what must be done to fix it
  • the timeframe for compliance

If the notice is not complied with

We may take further action, including:

  • issuing a fixed penalty notice
  • taking the case to the Sheriff Court by summary petition

Fixed penalty amounts

  • £400 for industrial, trade, or business premises
  • £150 for all other cases

Fines must be paid within 14 days from the day after the notice is served

Once the fine is paid and the nuisance is resolved, no further action is taken. If the fine is not paid, we may refer the matter to the Procurator Fiscal for potential criminal proceedings.
