Discharge of planning conditions

How to discharge planning conditions

If you have planning permission with conditions, you must apply to have those conditions agreed and discharged before starting work. From 1 July 2026, you need to submit a request to do this online and pay a fee of £124 per request. One fee covers all conditions included in that submission.

Applying early helps avoid delays and reduces the risk of enforcement if work starts before conditions are agreed.

Before you apply

  • allow enough time before starting work or before your permission expires
  • make sure all required information is included

Starting work without discharging conditions may lead to enforcement action.

How to apply

You can apply using our online form.

Email requests are no longer accepted.

When you apply, include:

  • your planning reference number
  • a summary of the condition or conditions
  • all required documents and plans

If your files are too large to upload, send them by file transfer to planning@southlanarkshire.gov.uk and include your reference number.

Fees

  • £124 per request
  • one fee covers one submission, even if it includes multiple conditions

You must pay the fee when you submit your request.

What happens next

Once we receive your request, we will:

  1. Check your submission and confirm it is valid
  2. Let you know if anything is missing
  3. Assess your information

You will receive an update or decision within 28 days of validation. If your case is more complex or we need more information, we will contact you within that time.

Important information

This process is only for discharging conditions attached to a planning permission.

  • for Matters Specified in Conditions, you must submit a formal planning application
  • to vary or remove a condition, you must apply under Section 42
