Privacy statement for National Entitlement Card (NEC)

How we use your information

South Lanarkshire Council is the data controller for the personal information you provide when applying for, requesting a replacement or updating a National Entitlement Card (NEC).

Why we are collecting and using your personal information

We use your personal information to:

  • process and assess your application to replace or update a National Entitlement Card
  • change the photograph or the address on your National Entitlement Card
  • confirm your eligibility for concessionary travel
  • produce and administer your replacement card
  • contact you about your application or your enquiries where required

As part of your application, we may collect and process personal information including:

  • name, address and contact details (such as email address and telephone number)
  • date of birth (including supporting evidence in some circumstances)
  • an updated photograph for your NEC
  • supporting evidence to confirm your address change (official documentation showing your name and new address) 
  • any additional information required. We will ask for your contact details so we can contact you if necessary, regarding your application or enquiries

Lawful basis and how long we keep personal information

We will only process your personal information when it is lawful to do so. For this processing, we are relying on Article 6(1) (e) of UK GDPR – processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority.

We keep your information as long as required by law. Personal information will be stored for as long as necessary to:

  • process your application and requested changes
  • administer the NEC scheme
  • meet legal and regulatory requirements

Information sharing

Your data will only be accessible by:

  • the National Entitlement Card Programme Office (NECPO), who administer the NEC scheme
  • Transport Scotland, who manage the national concessionary travel schemes
  • Strathclyde Partnership for Transport (SPT), who support the administration of the NEC scheme

We only share the minimum information necessary and ensure it is handled securely.

The council has a duty to protect public funds. We may check your information within the council for verification purposes and/or for the prevention of fraud. We may also share your information with other organisations where we are required to do so for the prevention or detection of crime.

Your rights

You have the right to ask us to:

  • tell you that we are using personal information about you, tell you what that information is, and who we have shared it with. You can also ask us for a copy of the information we have about you. This is called the right of access.
  • correct any wrong or misleading personal information that we have about you. This is called the right to rectification.
  • stop using any or all of your personal information. This is called the right to object.
  • delete or destroy your personal information under certain circumstances. This is called the right to erasure.
  • stop using your personal information until we can correct your personal information, give you our reasons for using your personal information or stop us from deleting your personal data if you need it in connection with any legal claims. This is called the right of restriction.
  • pass your personal information to someone else under certain circumstances. This is called the right to data portability.
