Disabled person’s parking bay
Disabled person’s parking bays are available in terms of the Disabled Persons Parking Places (Scotland) Act 2009. This Act requires the council to mark parking bays following requests from qualifying persons.
Why we are collecting and using your personal information
We will use the information you give us to check that you meet the criteria for a disabled person’s parking bay.
We will ask for the following information:
- Name (applicant and/or registered keeper)
- Full postal address
- Date of birth
- Phone number
- Email address
- Details of parking difficulties or other evidence, which may include information about your health
We will also ask you to upload certain documents to allow us to assess your eligibility, including your driving licence, the vehicle registration document (V5C), the Motability Scheme lease document and a copy of your Disabled Persons' Blue Badge.
Lawful basis and how long we keep personal information
We will only process your personal information when it is lawful to do so. For this processing, we are relying on Article 6(1) (e) of UK GDPR – processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority.
We keep your information as long as required by law. Personal information will be stored for 3 years from the date your application is granted or refused, or for 3 years from the date that any disabled person’s parking bay is removed.
We may also use information for research and statistical purposes. Your data will be stored securely on council systems and only viewed by those who have a lawful requirement to access it.
Information sharing
Your data will only be accessible by those employees inputting your data or those making decisions on your application to provide the service.
The council has a duty to protect public funds. We may check your information within the council for verification purposes and/or for the prevention of fraud. We may share your information with other organisations where we are required to do so for the prevention or detection of crime.
Your rights
You have the right to ask us to:
- tell you that we are using personal information about you, tell you what that information is, and who we have shared it with. You can also ask us for a copy of the information we have about you. This is called the right of access.
- correct any wrong or misleading personal information that we have about you. This is called the right to rectification.
- stop using any or all of your personal information. This is called the right to object.
- delete or destroy your personal information under certain circumstances. This is called the right to erasure.
- stop using your personal information until we can correct your personal information, give you our reasons for using your personal information or stop us from deleting your personal data if you need it in connection with any legal claims. This is called the right of restriction.
- pass your personal information to someone else under certain circumstances. This is called the right to data portability.
